The petitioner is in custody since 27.08.2017 in connection with Raghopur P.S. Case No. 89 of 2017 for the offence registered under Sections 363 and 366A of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is allegation of kidnapping, the victim girl in her statement made under Section 164 Cr.P.C. has stated that nobody has kidnapped her rather she had gone with the petitioner on her sweet will. It is further submitted that the age of the victim girl is between 17-18 years.

Considering the statement made under Section 164

Patna High Court Cr.Misc. No.60606 of 2017 (3) dt.18-01-2018 2/2 Cr.P.C. and that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. -IV, Hajipur, Vaishali in connection with Raghopur P.S.
