2. The petitioner seeks regular bail in the present case registered for the offence under Sections 147, 149, 341, 323, 342, 448, 325, 307, 379, 504, 506, 302 of the Indian Penal Code.
3. As per the prosecution case, petitioner is alleged to have brutally assaulted and killed the deceased.
4. Learned counsel for the petitioner submits that petitioner is in custody since 05.04.2024 and has clean antecedent. The post-mortem report does not support the prosecution case. Material witnesses have already been examined. For the two months, no witness has been examined.

5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the fact that the trial is being delayed by the prosecution, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-III Class, Nalanda/concerned Court below in connection with Bind P.S. Case No. 50 of 2024.
