JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This is an application for grant of anticipatory bail in connection with Excise Case No. 72C3 of 2013, disclosing offences under Section 47 (a) of the Excise Act. Case is of the year 2003. Recovery of liquor from the field and petitioner is named in the F.I.R.

Submission of the learned counsel for the petitioner is that the field from which the liquor was recovered, that does not belong to the petitioner. He has no knowledge of this case earlier.

Heard learned A.P.P. also.

Having heard both sides, in view of the submissions, as made above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail,

Patna High Court CR. MISC. No.74349 of 2019(2) dt.17-01-2020 2/2 which shall be considered on its own merit, without being prejudiced by order of this Court, and if possible to be disposed of on the same day.
