JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 27097 (C)/2014, disclosing offences under Sections 379, 427 read with 34 of the Indian Penal Code. Allegation against the petitioner is of committing theft of photostat machine, printer as well as cash of Rs. 9,000/- from the shop of the informant.

Submission of learned counsel for the petitioner that he has falsely been implicated in this case, which will appear from the fact that police after investigation submitted final form against the petitioner, however, cognizance has been taken against the petitioner on protest by the complainant. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Patna, in connection with Complaint Case No. 27097 (C)/2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
