Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks bail in connection with Belsand P.S. Case No. 5 of 2019, registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-B)(a), 26(2) and 35 of the Arms Act.

There is recovery of AK56 rifle from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated at the instance of co-accused person and he is in custody for more than one year and he is ready to co-operate in disposal of trial.

Heard learned APP and perused the report of learned court below from which it appears that charge has been framed in this case and summons have been issued to the prosecution witnesses and the court assures that trial will be concluded

Patna High Court CR. MISC. No.66550 of 2019(4) dt.20-02-2020 2/2 within a period of six months.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, if trial is not concluded within a period of six months from the receipt of this order, petitioner is at liberty to renew his prayer for bail. It is expected that petitioner shall co-operate in disposal of trial. At the same time, the Superintendent of Police, Sitamarhi is directed to ensure the presence of the witnesses in court on the date fixed so that the trial may be concluded within the above period.

Accordingly, this application is dismissed.
