JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Uchakagaon P. S. Case No. 181 of 2019 disclosing offences under Sections 341, 323, 324, 308, 504, 506, 34 of IPC.
As per F.I.R. there is allegation against the petitioner of assault by Sword to the informant, causing injury. Submission of the learned counsel for the petitioner is that both petitioner and informant are Pattidars and there is case and counter case between the parties. Further submission is that even impugned order disclosed that CT Scan report has not been produced by the injured and genesis of occurrence is not serious and a proceeding under Section 107 Cr.P.C. was also going on, but in spite of that his prayer for anticipatory bail was rejected. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gopalganj, in connection with Uchakagaon P. S. Case No. 181 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
