JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act,2016.

21 litres 130 Ml. liquor are said to have been recovered from the house of the petitioner but according to prosecution case itself, the aforesaid recovery was not made in presence of the petitioner and allegedly, he managed to flee from his house at the time of raid. Paragraph 3 of the petition goes to show that petitioner does not have any criminal antecedents. Moreover, the petitioner is in jail custody since 13.8.2019.
