The petitioner seeks bail in a case registered for the offences punishable under Sections 365, 302, 201 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.06.2022 , is a person with clean antecedent.

The informant alleges that his son, after informing her mother, accompanied Devendra Sahni on a motorcycle, further, when he did not return home late in the night, the informant called on his mobile number but he did not pick the phone, thereafter, his location was traced through G-mail and it

No.71426 of 2022(2) dt.29-04-2023 2/3 was found that the victim was near river Budhi Gandak, it is further alleged that, thereafter, the informant along with his family members and the police went to the place of occurrence where the dead body of his son was found, it is next alleged that he also came to know that Prabhat Kumar and Ramesh Sahni (petitioner) were also present along with his son on the fateful day.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that specific allegation of the informant is that his son accompanied Devendra after informing his mother, it is also submitted that the FIR does not disclose that who informed the informant that this petitioner was also present at the place of occurrence along with the son of the informant. Learned counsel for the petitioner, at the cost of repetition, submits that the petitioner is a person with clean antecedent and the charge-sheet has been submitted and the petitioner will not abscond.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Case No. 410 of 2022.
