JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This application for grant of anticipatory bail in connection with Singheshwar P.S. Case No. 192 of 2018, disclosing offences under Sections 363/511 of the Indian Penal Code and Section 8 of the POCSO Act.
Allegation against the petitioner is that he along with other accused person have lifted the minor daughter of the informant towards the bank of river, however on alarm, the villagers chased them and caught hold the co-accused and the petitioner succeeded in fleeing away.
Submission of learned counsel for the petitioner is that no offence under Section 8 of the POCSO Act has been made out against the petitioner and petitioner has not arrested from the spot.
Heard learned A.P.P. also, who opposed the prayer for
Patna High Court Cr.Misc. No.77876 of 2018(2) dt.03-01-2019 2/2 anticipatory bail of the petitioner.
Having heard both sides, considering the above submission, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the court below and pray for regular bail, which will be considered on its own merit without being prejudice by order of this Court.
