The petitioner apprehends his arrest in connection with Bettiah (Town) P.S. Case No. 433 of 2019, registered under Section 307 and other allied Sections of the Indian Penal Code. The accusation is that on 25.05.2019, at about 3.30 P.M., informant reached at Chanakya Coaching Centre, where seven persons named in the F.I.R. including the petitioner under conspiracy forcibly carried him behind the showroom of Yamha Motorcycle, where 25 unknown persons surrounded him. Thereafter, on the order of Ninki, all started to cause assault through iron rod and knife. At that time, Nanki snatched gold

Patna High Court CR. MISC. No.64519 of 2019(2) dt.04-11-2019 2/2 chain from his neck and Golu Kumar snatched Rs.10,000/- from his pocket.

Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. but no specific overt act has been attributed against him. Further submission is that while the occurrence is said to be of 25.05.2019 but the present case has been lodged on 05.06.2019 after ten days of the occurrence. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah (Town) P.S. Case No. 433 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
