2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 325, 323, 365, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, these petitioners along with one named accused person and 10 to 15 unknown persons came armed with weapons, tied the hands and legs of the informant and took him at some unknown place and subjected him to assault and also tried to take left thumb impression of the informant on stamp paper.
4. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in this case due
Patna High Court CR. MISC. No.75221 of 2023(2) dt.29-11-2023 2/2 to land dispute between the parties. A title suit being T.S. No. 34 of 2021 is pending before the court of learned Sub-Judge VI, Danapur and with a view to pressurize the petitioners in the said case, the informant has brought this false case. It is further submitted that FIR has been lodged after delay of three months for which no explanation has been given. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Danapur, Patna, in connection with Bihta P.S. Case No.553 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) shashank/- U T
