The petitioner apprehends his arrest in connection with Dalsingsarai P.S. Case No.215 of 2024, registered for the offence punishable under Sections 365, 406, 420, 120B, 328, 308, 304, 34 of the Indian Penal Code.

As per the FIR, the petitioner and other co-accused hatched a conspiracy and killed the son of the informant by feeding him poisonous substance and also by giving him wrong treatment and medicines.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. There is no specific

Patna High Court CR. MISC. No.76192 of 2024(2) dt.18-11-2024 2/2 overt act against the petitioner. Petitioner has no concern with the alleged occurrence. He has been made accused only with a view to extort money from him. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

Accordingly, this application is dismissed.
