2. The present petition has been filed for quashing the order dated 09.08.2019 passed by learned Sub Judge-1, Lakhisarai in Title Suit No.90 of 2011, whereby and whereunder the learned trial court has rejected the petition dated 28.11.2018 filed by the petitioner under Order 7 Rule 11 of the Code of Civil Procedure. Against such an order, a civil revision petition under Section 115 of Code of Civil Procedure would lie.

3. In these circumstances, learned counsel for the petitioner seeks permission to convert the present civil miscellaneous petition into civil revision petition.

4. Permission is accorded.

5. Learned counsel for the petitioner is directed to convert the present civil miscellaneous petition into civil
