2. The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 234 of 2021 for the offence registered under Sections 414, 272, 273 of the IPC and Section 30(a) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, 1000 litres of country made liquor recovered from Bolero vehicle and two co-accused persons namely Murari Kumar and Akash Kumar were arrested on the spot. Petitioner is the owner of the seized Bolero vehicle.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case being the owner of the seized vehicle in question which was taken away by the co-accused Murari Kumar on rent and
Patna High Court CR. MISC. No.71101 of 2025(2) dt.08-10-2025 2/2 the petitioner had no knowledge about the misuse of seized vehicle by the co-accused. He has no concern with the seized liquor. Nothing incriminating has been recovered from the conscious possession of the petitioner. Petitioner is in jail custody since 14.08.2025, having one criminal antecedent but the same does not belong to the Excise Act in which he has been acquitted. Petitioner undertakes to cooperate in the investigation and trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, nature of allegation and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1-cum-A.D.J., Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 234 of 2021.
