JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 307, 354, 447, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged against the petitioner that he along with co-accused Sugandh Kumar Manjhi entered into the house of the informant and this petitioner shot fire at the grand-son of the informant which hit his hand. The
Patna High Court CR. MISC. No.72622 of 2022(4) dt.27-06-2023 2/3 accused persons also threatened of dire consequences. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is counter version of the occurrence also and petitioner's side also sustained injuries. For the alleged occurrence of 03.08.2021, the F.I.R was lodged on 04.08.2021 without explaining the delay. The injury has been made in the non-vital part of the body. The petitioner is languishing in custody since 07.06.2022.
Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur in connection with Patori P.S. Case
