JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This is an application for grant of anticipatory bail in connection with Khagaria P.S. Case No. 696 of 2018, disclosing offences under Sections 25(1-b)A/26/35 of the Arms Act. Allegation as per F.I.R. is that police received an information that some accused persons including the petitioner are engaged in an illicit business of supply of arms and the accused persons are going along with the arms and police raided the place and apprehended two accused persons from whom carbine and country made pistols were recovered and the petitioner succeeded in fleeing away and he is named in F.I.R. Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.78462 of 2018(2) dt.09-01-2019 2/2 Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
