2. The petitioner is apprehending his arrest in connection with Suryagarha P.S. Case No. 279 of 2024 registered for the offence punishable under Sections 191(2), 126(2), 115(2), 109(1) and 3(5) of BNS and 27 of the Arms Act.

3. As per prosecution case, co-accused Amar Kumar, Mohit Kumar and Dhiraj Kumar assaulted the informant by means of sword. It is alleged that when informant's mother came to rescue, petitioner and four others assaulted on the face and hand of informant's mother by means of revolver.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged

He further submits that there is no specific allegation of assault against the petitioner rather the same is general and omnibus in nature. Learned counsel further submits that petitioner along with four others assaulted the informant's mother but injury is said to be simple in nature. He further submits that co-accused Amar Kumar, Mohit Kumar and Dhiraj Kumar assaulted the informant by means of sword. There is case and counter case between the parties for the same date of occurrence and hence, free fighting cannot be ruled out. He further submits that FIR clearly indicates that there is land dispute between the parties and in cases of land disputes, facts are generally exaggerated to make the offence graver. Petitioner bears criminal antecedent of four cases, out of which in three cases he is on bail.

5. The learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that petitioner along with others has participated in the alleged occurrence and hence, he does not deserve anticipatory bail.

6. Considering the facts and circumstances of the case, there is no specific allegation of assault against the petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the

No.74036 of 2025(2) dt.17-11-2025 3/3 petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Suryagarha P.S. Case No. 279 of 2024, subject to the conditions as laid down under Section 482(2) of B.N.S.S.

7. The application stands allowed.
