2. The petitioner seeks regular bail in connection with Bahadurpur P.S. Case No. 398 of 2024 registered for the offence under Sections 30(a)/32,41(2)(1) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 468 litres illicit spirit was recovered from the vehicles.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 21.09.2024 having clean antecedent. The petitioner has no concern with the alleged recovery.
5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and also considering the period of custody, this application for regular bail is allowed.
7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Patna City in connection with Bahadurpur P.S. Case No. 398 of 2024, subject to the condition that the petitioner will mark his attendance at Ramkrishna Nagar Police Station on each Sunday of the month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. Before accepting bail bonds of the petitioner, the court below will verify the criminal antecedent of the petitioner. (Sandeep Kumar, J) Ranjeet/- U T
