2. The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 171 of 2023, registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act.
3. As per allegation, on secret information, the police personnel found two persons sitting on the motorcycle and a bag was kept between them, which was indicated to stop but the said motorcycle has not stopped. On chase, one person was apprehended and 40 liters of country made wine filled in 80 pieces of 500 M.L. of plastic bottle was recovered from the alleged motorcycle. Thereafter, the apprehended person
Patna High Court CR. MISC. No.72915 of 2023(3) dt.29-02-2024 2/2 disclosed that the person, who fled away, was the wine trader and doing business of illegal liquor.
4. The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Nothing was recovered from his conscious possession and the petitioner has no concern with the alleged vehicle or liquor. The petitioner was not arrested at the spot. The petitioner has three criminal antecedents of similar nature.
5. Taking into consideration the fact that the petitioner is involved in other cases of similar nature, I do not think it to be a fit case for grant of anticipatory bail, which is hereby rejected.
