Petitioner prays for bail in connection with Dehri (T) P.S.Case No. 815 of 2017 registered for the offences punishable under Sections 307, 302 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of repeated firing on the husband of the informant and causing his death. Submission of learned counsel for the petitioner is that there is land dispute between the parties and there is case and counter case and petitioner has also received injury and petitioner is in custody since 28.10.2017.

Heard learned APP and learned counsel for the

Patna High Court Cr.Misc. No.24920 of 2018 (6) dt.24-09-2018 2/2 informant. They have opposed the prayer for bail stating that in paragraphs 27 and 28 of the case diary, eye-witnesses have supported the case and petitioner is the main assailant of the deceased.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

Accordingly, this application is dismissed.
