2. Earlier twice, the prayer for bail of petitioner has been rejected. Lastly, the prayer for bail of petitioner was rejected, vide order dated 08.09.2023 passed in Cr.Misc. No.47444 of 2023.

3. Trial Court report reveals that the case is still pending for evidence of prosecution witnesses.

4. Learned counsel for the petitioner submits that petitioner is in custody since 28.12.2019 and till date, trial has not been concluded. Case is still running for prosecution evidence. He further submits that similarly situated co-accused Virendra Sharma has already been granted bail by a coordinate Bench of this Court, vide order dated 13.09.2024 passed in Cr.Misc. No. 27534 of 2024.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the period of custody and tardy progress of trial, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge - V, Vaishali at Hajipur in connection with S.Tr.No. 131/2020 + 172/2020, arising out of Hajipur Town P.S. Case No. 1052 of 2019.
