2. The petitioner seeks bail in connection with Chandauti P.S. Case No. 252 of 2024 registered for the offence under Sections 331 (4) and 305 (a) of the Bhartiya Nyay Sanhita.

3. As per the prosecution case, the petitioner is alleged to have committed theft.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has no criminal antecedent. He also submits that the petitioner is in custody since 6.7.2024.

5. Considering the aforesaid facts, this application

Patna High Court CR. MISC. No.75370 of 2024(2) dt.23-10-2024 2/2 is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Chandauti P.S. Case No. 252 of 2024.

7. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the criminal antecedent of the petitioner. If the Court below finds that the petitioner has no criminal antecedent, his bail bonds shall be accepted. If the Court below finds that the petitioner is involved in any other case, his bail bonds shall not be accepted.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Vishnupath Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
