Petitioner is apprehending his arrest in connection with Bihpur P.S. Case No.47 of 2024, registered for the offence punishable u/s 147, 148, 149, 447, 385, 387, 307, 504, 506 of IPC and 27 of Arms Act.

Allegedly, petitioner along with some known and unknown co-accused persons came to the informant's house and started abusing for demand of extortion. It is further alleged that the petitioner along with one another co-accused started firing with the intention to create fear.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to previous
Patna High Court CR. MISC. No.75167 of 2024(2) dt.11-11-2024 2/2 enmity. Nobody sustained injury in this incident. No incriminating article or blood stain has been found from the place of occurrence. It is further submitted that the cartridges had been put in front of informant's main gate to make the case grave. Petitioner has no criminal antecedent. 5.
Learned APP for the State opposed the prayer for bail by submitting that there is specific allegation of firing upon the informant against the petitioner.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
