JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application, for grant of anticipatory bail, arises out of Vaishali P.S. Case No. 173 of 2019, disclosing offences under Sections 147, 148, 149, 353, 332, 333, 307, 504 of the Indian Penal Code.
Petitioner is named in the F.I.R. along with several other accused persons and allegation against them is of assault to the police personnel, while they were on patrolling duty and had gone to arrest accused persons involved in selling toddy. Submission of learned counsel for the petitioner is that though he is named in the F.I.R, no specific allegation has been attributed to him and other accused persons have already been granted the privilege of anticipatory bail vide order dated 23.08.2019 passed in Cr. Misc. No. 52951 of 2019, vide order dated 03.09.2019 passed in Cr. Misc. No. 55849/2019 and vide
Patna High Court CR. MISC. No.67122 of 2019(2) dt.24-10-2019 2/2 order dated 19.07.2019 passed in Cr. Misc. No. 44636 of 2019. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S.
