1. Heard learned counsel for the petitioner and learned A.P.P. for the State Mr. Ravindra Kumar.

2. Learned counsel for the petitioner submits that petitioner was granted the privilege of anticipatory bail by an order dated 03.09.2024 with a condition that one of the bailors of the petitioner shall be his father and the petitioner was directed to surrender within a period of six weeks. It is next submitted that in terms of the order dated 03.09.2024, in Cr. Misc. 55636 of 2024, the last date for surrendering was 15.10.2024. It is next submitted that father of the petitioner being a landless person, tried to furnish the security of Rs. 25,000/- but was not able to manage the same, as such, the instant modification application was filed on 05.10.2024 i.e. 10 days prior to the date of surrendering with a prayer to modify

No.55636 of 2024 on the ground that father of the petitioner is not in a position to furnish the security. The learned counsel thus submits that mother of the petitioner, namely, Shobha Devi, who has sworn the present modification application be made a bailor, as she is in a position to furnish the security.

4. Learned A.P.P. for the State also does not oppose the prayer made by the learned counsel appearing on behalf of the petitioner.

5. In view of the submission made by the learned counsel for the petitioner, the order dated 03.09.2024 in Cr. Misc. No.55636/2024 is modified to the extent that one of the bailors of the petitioner shall be his mother, namely, Shobha Devi, instead of his father namely, Kare Mahto. Further, if the petitioner surrenders on or before 20.12.2024, the petitioner shall be released on bail on his furnishing bail bonds in the sum of Rs.25,000/-.

6. The instant modification application is allowed to the extent indicated above.
