The only grievance raised in the present writ petition is notwithstanding specific direction of this Court in CWJC No. 5843 of 2008 (Saroj Singh Sisodia Vs. The State of Bihar & Ors.) vide order dated 25.07.2011 that the period 16.3.1994 to 29.1.2000 shall not be treated as break in service and shall be calculated for pensionary benefits, has not been complied with as yet.

Patna High Court CWJC No.19204 of 2017(2) dt.24-02-2020 2/2 In view of the specif direction issued by this Court in CWJC No. 5843 of 2008, the present writ petition is disposed of with a direction to the respondents to count the aforesaid period for the purpose of length of service for fixation of pensionary benefits and grant of consequential benefits treating the length of service including the aforesaid period. Necessary corrective measures must be taken by the respondents within a maximum period of 3 months from the date of receipt/production of a copy of this order and grant all consequential benefits of continuance of service in the matter of fixation of pension and benefit thereof.

With the aforesaid, the writ petition stands disposed of.
