2. The petitioner seeks bail in connection with Sugauli P.S. Case No. 356 of 2025, instituted for the offences punishable under Sections 127(1), 115(2), 118(1), 117(2), 109, 303(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that the petitioner along with other co-accused persons assaulted the informant and her son along with her Gotia for land dispute due to which they sustained injuries and they also disrobed the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for

Patna High Court CR. MISC. No.71118 of 2025(2) dt.09-10-2025 2/2 the petitioner also submits that there is delay of three days in lodging the FIR. The informant is sister-in-law of the petitioner. No specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. It is further submitted that there is admitted land dispute between both the parties and for the same a Title Partition Suit is pending before the learned Court below. The petitioner is in custody since 11.07.2025 and has got three criminal antecedents.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sugauli P.S. Case No. 356 of 2025.
