The petitioner has prayed for regular bail in a case instituted for the offence under Sections 364(A)/34 of the Indian Penal Code, Sections 16,18 and 20 of U.A.P. Act and Section 27 of the Arms Act.

The allegation against the petitioner is that he along with 30-40 accused persons, who are Naxals have kidnapped Ramji Yadav and his son Dharmveer Kumar @ Kumkum for demanding ransom money.

Patna High Court CR. MISC. No.71930 of 2022(3) dt.05-04-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that there is general and omnibus allegation against the petitioner. There is no consistent material and evidence against the petitioner to show his involvement in the said occurrence. He submitted that the victim was recovered and his statement recorded u/s 161 of the Cr.P.C., in which he has not taken the name of the petitioner, only on the basis of confessional statement of co-accused Guddu Yadav @ Guddan Yadav, the name of the petitioner has come into light. He further submitted that the other co-accused has already been granted bail by a Co-ordinate Bench vide order dated 24.02.2023 passed in Cr. Misc. No. 32795 of 2022. He is languishing in judicial custody since 24.06.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM-
