The petitioner seeks bail in connection with Baisi P.S. Case No. 202 of 2016 for the offence under Sections 294A and 420 of the Indian Penal Code read with Section 4/5 of the Bihar Ban on Lottery Act, 1993 and Section 7(3) of the Lottery Regulation Act, 1998.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the petitioner has been made accused in this case on the basis of mobile number stated by the apprehended persons from which the petitioner has no concern. Nothing incriminating has been recovered from the
Patna High Court CR. MISC. No.65331 of 2019(2) dt.04-11-2019 2/2 conscious possession of the petitioner. The petitioner is rotting in judicial custody since 26.08.2019. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st, Class, Purnia in connection with Baisi P.S. Case No. 202 of 2016.
