The petitioner is in custody since 22.07.2019 in connection with G.O. Case No. 734 of 2019 arisen out of Bahadurpur P.S. Case No. 356 of 2019 registered for the offence punishable under Sections 30(a) and 38 (1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the rack point as per the seizure list. It is further submitted that except one other criminal antecedent, the petitioner has no criminal antecedents.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on

Patna High Court CR. MISC. No.65533 of 2019(2) dt.25-10-2019 2/2 bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ -II cum Special Judge, Excise Act, Darbhanga in connection with G.O. Case No. 734 of 2019 arisen out of Bahadurpur P.S. Case No. 356 of 2019.
