NILU AGRAWAL ORAL ORDER 19-12-2018 Heard the learned counsel for the petitioner, the learned counsel appearing for the State as well as the learned counsel appearing for the Accountant General, Bihar, Patna. A counter affidavit has been filed by the respondents 8 and 9, the Treasury Officer, Muzaffarpur, and the District Provident Officer, Muzaffarpur, stating that all payments have been made, except a sum of Rs.15,000/- has been deducted from the gratuity amount.

Learned counsel for the petitioner also accepts that payment of all his retiral dues, except Rs.15,000/-, which has been deducted from the gratuity has been paid to the petitioner. He submits that no reason has been assigned for such deduction.

Patna High Court CWJC No.3925 of 2018(6) dt.19-12-2018 2/2 Considering the submissions of the parties, the present writ application is disposed off with a direction to the petitioner to file a representation before the respondent no. 4, the Joint Director, Agro, Tirhut Division, Muzaffarpur, for the said payment and a reasoned order would be passed by the respondent no. 4 within a period of two months from the date of filing of such representation. The admissible amount will be paid to the petitioner within a month thereafter. If the said amount of Rs.15,000/- is not admissible, the same shall be communicated by speaking order to the petitioner through registered post.
