This application for grant of regular bail arises out of Forest Case No. 19F of 2022 (CIS-F-19/2022Balmiki Nagar) registered for the offence punishable under Sections 2, 33, 41, 42 of the Indian Forest Act and under Sections 2, 27, 29, 31, 51 of the Wild Life Protection Act, 1972. 4.

As per the prosecution case, one Sagwan tree was found cut by the miscreants. No one was arrested from the place of occurrence and subsequently, the name of the petitioner has transpired as having participated in the illegal cutting of Sagwan tree.

The petitioner is in custody since 06.07.2023 and he has criminal antecedent.

Looking to the nature of allegation as well as the period of custody of the petitioner, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Forest Case No.19F of 2022 (CIS-F19/2022-Balmiki Nagar). 8.

This is also subject to the condition that the petitioner shall mark his presence in Sahodra Police Station, District- West Champaran on every Sunday and Friday of the week.
