Mr. Sri Bisheshwar Ram ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 15-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Town P.S.Case No. 695 of 2012 registered under Sections 304B and 328/34 of the Indian penal Code. Learned counsel for the petitioner submits that petitioner's wife died due to jaundice.
However learned counsel for the State submits that petitioner is husband and within three years of the marriage, wife was killed as further demand of dowry was not fulfilled and anticipatory bail application of the petitioner was rejected in the year 2015 by this Court and subsequently by the Apex Court and he has surrendered on 23.06.2017.
Having considered the aforesaid facts and circumstances, the Court is not persuaded to grant bail to the petitioner at
Patna High Court Cr.Misc. No.5976 of 2018(9) dt.15-05-2018 2/2 present, his prayer of bail is rejected. As already trial has delayed so trial court is directed to expedite the trial and preferably conclude the same within one and half year. If trial is not concluded within stipulated period, petitioner may renew his prayer of bail.
