The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 354D, 506, 354, of the Indian Penal Code and Sections 4 and 12 of the POCSO Act.

As per prosecution case, informant alleged that on 06.10.2022, while she was returning home with her sister. In the meantime this petitioner suddenly came and outraged her modesty.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to village politics. It is also submitted that the victim is major and the petitioner had not

No. 72532 of 2022(2) dt.20-03-2023 2/2 touched her body rather at the instance of the enmity, he had forcibly arrested by local people and handed over to Sarpanch, where this matter has already been compromised by both parties. Petitioner has got no criminal antecedent moreover, he is languishing in judicial custody since 08.10.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jandaha P.S. Case No. 305 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI cum-Special Judge POCSO Vaishali at Hajipur.
