Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners submits that the bail applications have been earlier rejected vide order dated 10.10.2022 in Cr. Misc. 52736 of 2021 with liberty to renew his prayer for bail after one year of framing of the charge. Counsel for the petitioner submits that charge has been framed in this case on 22.07.2021 and one year has already been lapsed as well as report has been called for. From the report, it transpires that 6 prosecution witnesses have been examined and case is fixed for prosecution evidence. Learned counsel for the State also submits that one

Patna High Court CR. MISC. No.73762 of 2022(3) dt.22-02-2023 2/3 year has already been lapsed and charge has been framed. Learned counsel for the informant also present and submits that 6 prosecution witnesses have been examined. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Rosera, Samastipur in connection with Singhiya P.S. Case No. 12 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with other following conditions: A. The petitioner shall support in trial and shall appear physically before the lower court on each and every date fixed, in case of non-appearance for two consecutive dates without sufficient cause, shall be resulted into cancellation of his bail bond.

B. One of the bailors shall be close relative who shall file affidavit before the court about his relationship with the petitioner.

C. The petitioner shall file an affidavit at the time of furnishing of bail bond that he shall not involve in such criminal activity during the continuance of present bail bond, violation of

With this observation, the bail application stands allowed.
