The petitioner seeks regular bail in connection with Bind P.S. Case No.121 of 2017 for the offences punishable under 272, 273 of the Indian Penal Code and Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation of the prosecution is regarding recovery of 197 liters of foreign liquor from Magic vehicle and on the statement of the driver of the said vehicle, the name of the petitioner has transpired in the present case. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present, no recovery has been made from his conscious possession and he is

Patna High Court Cr.Misc. No.845 of 2018 (2) dt.18-01-2018 2/2 languishing in jail custody since 24.11.2017. Considering the nature of accusation and the period of custody already undergone though I am inclined to grant regular bail to the petitioner but since the petitioner has three more cases pending against him, I deem it fit and proper to enlarge the petitioner, above named, on bail on furnishing bail bonds of Rs. 1,00,000/- (Rs. One lac) with two sureties of the like amount each to the satisfaction of learned VIth Additional Sessions Judge-IIcum Special Judge (Excise), Nalanda (Bihar Sharif), in connection with Case No. Bind P.S. Case No. 121 of 2017. It is further directed that in case the petitioner is implicated in similar type of cases, henceforth, the present privilege of bail shall stand automatically cancelled forthwith.
