Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 354B, 379, 307, 504 and 506 of IPC. 3.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 12-9-2023, the mobile of her son was taken by Manohar and he was not returning the mobile despite her son Nitish requesting, on which Nitish threatened to institute a case, further on 17-9-2023, the named accused persons including the petitioners intercepted Nitish when he was going to cut grass

No.71020 of 2025(2) dt.04-11-2025 2/3 and abused saying he will be killed if he institutes a case, thereafter the accused persons assaulted Nitish causing injury on head, on alarm informant along with her younger son Jyotish reached the place of occurrence when all the accused assaulted Jyotish causing injury on head and dashed the informant on the ground and Manohar snatched her mangalsutra.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that allegation of assault is not specific. It is also submitted that had so many accused assaulted the injured, in that event they would have suffered multiple injuries, but then from perusal of the injury report annexed as Annexure-2 series to the anticipatory bail application, it would manifest that Nitish suffered injury -- swelling over left parietal area of scalp and abrasion on right side of forehead, while Jyotish suffered injury - abrasion and swelling over left elbow and swelling over mid head. It is submitted that allegation of assault is general and omnibus in nature and the entire family members and relatives of Manohar have been implicated and petitioners are not criminals. 5.

Learned A.P.P. for the State opposes the prayer for

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gwalpara (Arar O.P) P.S. Case No. 182 of 2023, subject to the conditions as laid down under Section 482 (2) of the BNSS. (Satyavrat Verma, J) Sumit/- U T
