JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)A, 26, 35 of the Arms Act. One country made loaded Katta is said to have been recovered from conscious possession of the petitioner when he along with others assembled to make preparation for committing dacoity. Petitioner does not have any criminal antecedent and is languishing in jail custody since 17.07.2019. Submission on behalf of the petitioner is that nothing was recovered from his conscious possession and, as a matter of fact, petitioner had gone to attend the call of nature but

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Morhowra P. S. Case No. 476 of 2019.
