SONI SHRIVASTAVA ORAL ORDER 23-02-2026 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. None appears on behalf of O.P. No. 2, despite issuance of notice.

2. Present case has been filed through the Patna High Court Legal Services Authority by the panel advocate. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2) and 115(2)/76 of the B.N.S. and Section 8 and 12 of the POCSO Act.

3. Petitioner is said to have committed wrong with the victim.

4. Learned counsel for the petitioner has submitted that the petitioner is in fact a priest in the temple and his rival party with the intentions to oust him from the temple has made a false allegation against him of outraging the modesty of the

No.76695 of 2025(5) dt.23-02-2026 2/3 informant/victim with allegations of inappropriate touching etc. However, it has been submitted that there is no allegation of any sexual intercourse or attempt thereof, as such, the victim has not been subjected to any medical examination. The FIR has also been lodged after a delay of 2 days and the petitioner is in custody since 14.04.2025 with no criminal antecedent and charge-sheet has been submitted.

5. Learned APP for the State has opposed the application for bail on the ground that there is allegation against the petitioner with stand supported in the statement of the victim girl.

6. Taking into consideration the facts and circumstances and also considering the delay in lodging of the FIR coupled with the fact that the allegation relates to outraging of modesty and teasing the informant/victim, not necessitating a medical examination etc. and the petitioner is a poor man with no criminal antecedent and charge-sheet having been submitted, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jamalpur P.S. Case No. 28 of 2025.

7. The petitioner is directed to appear on each and every date fixed in the case and cooperate in getting the charges framed, in case they have not been framed till date and if the petitioner does not appear on two consecutive dates without any substantial and satisfactory reason, the learned court below would be at liberty to cancel his bail bonds.
