2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with Paroo P.S. Case No. 359 of 2023 registered for the offence under Section 392 of the Indian Penal Code.

4. As per the prosecution case, four criminals have looted Rs. 30,721/- and one tab from the informant and during investigation materials have come to connect the petitioner with the crime.

5. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.74205 of 2023(2) dt.29-11-2023 2/3 petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. He further submits that the petitioner undertakes to pay Rs. 30,000/- to the informant without being prejudiced to his case and without accepting his guilt.

6. Learned counsel for the petitioner also submits that the petitioner is in custody since 20.08.2023.

7. Learned A.P.P. has vehemently opposed the prayer for bail.

8. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Court No. 2, Muzaffarpur in connection with Paroo P.S. Case No. 359 of 2023.

10. As a condition of this order, the petitioner is directed to bring a demand draft of Rs. 30,000/- in the name of the informant at the time of furnishing his bail bonds and the same shall be released in favour of the informant by the Court below.

11. After being released on bail, the petitioner is directed to mark his attendance at Paroo Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
