This application has been filed for quashing the order dated 22.07.2022 passed by learned C.J.M. Jehanabad taking cognizance for the offences under Sections 420, 467, 468 and 471 read with Section 120(B) of the Indian Penal Code arising out of Ghosi P.S. Case No. 196 of 2022 dated 25.04.2022 in G.R. No. 192 of 2022.
Pursuant to the order dated 29.03.2023, the Superintendent of Police, Jehanabad is present in the Court today and has filed his report in this matter.
Patna High Court CR. MISC. No.72507 of 2022(5) dt.12-04-2023 2/3 The Superintendent of Police, Jehanabad submits that petitioner is one of the accused involved in the crime and other members of the group are also being caught and they will also be put on trial. He further submits that three more accused persons apart from the petitioner have been arrested and some more arrest are to be made by the police.
The police after investigation will submit final charge-sheet then only the trial of the petitioner and other accused will commence. The trial court is directed not to proceed only against the petitioner but the Trial court will await for the final charge-sheet and thereafter will proceed with the trial.
Since the petitioner is on bail, he is bound in law to cooperate in the investigation as and when he is called by the Investigating Officer of the case, he will cooperate in the investigation.
The apprehension of the learned counsel for the petitioner is that the petitioner may be harassed by the police and the same is mis-founded.
In view of the aforesaid, this application is disposed of with liberty to the petitioner to challenge any further order by the Court in accordance with law.
