JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This application, for grant of anticipatory bail, arises out of Buniyadganj P.S. Case No. 86 of 2019, disclosing offences under Sections 341, 323, 337, 354, 504, 506 and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner and other accused persons misbehaved with a lady, for which, Chairman of Mohalla Committee convened the meeting and decided to punish the accused persons, however, the accused persons appeared and abused the committee member and assaulted them by means of brick.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and only vague allegation has been levelled that he misbehaved with the girl, as there is no mentioning about the name of the girl, though there

Having heard both sides, in view of the submissions as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VIII, Gaya, in connection with Buniyadganj P.S. Case No. 86 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
