The petitioner apprehends his arrest in Araria (Madanpur) P.S. Case No.279 of 2019 registered under Sections 341, 323, 386, 435, 427, 504, 506/34 of the Indian Penal Code. The informant alleged that petitioner and others intercepted him and asked him why the extortion was not paid. It is further alleged that when the informant showed his inability to pay the extortion, the petitioner fled away with the motorcycle of the informant. Shambhu Jha took the motorcycle of the petitioner and when he was to leave the place, many persons assembled there but in the meantime, Shambhu Jha set ablaze in the motorcycle of the petitioner in order to save himself.
The learned counsel for the petitioner submits that the

No.69587 of 2019(2) dt.15-11-2019 2/2 motorcycle of the petitioner was set ablaze and the petitioner was not even present on the place of occurrence but it appears that petitioner fled away with the motorcycle of the informant only thereafter Shambhu Jha in order to save himself from the crowd set ablaze the motorcycle of the petitioner. The petitioner has got criminal antecedent and he is accused in as many as four other cases registered under Section 302 and other Sections of the Indian penal Code as well as for transporting counterfeit currency and Arms Act.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
