The petitioner has prayed for bail in a case registered for the offence punishable under sections 302, 201, 120B/34 of the Indian Penal Code.

It is a case of commission of murder of the informant's son by the accused persons and they threw his dead body near railway station as he was in illicit relation with the daughter of co-accused Binod Shah.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. No one is the eye witness of the alleged occurrence. His name has been surfaced in this case on the basis

Patna High Court CR. MISC. No.72852 of 2022(3) dt.18-04-2023 2/2 of confessional statement of co-accused Vishwanath Kumar and Brajesh Kumar, before the police which has no evidentiary value in the eye of law. Petitioner is languishing in judicial custody since 27.5.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Rail, Bettiah, West Champaran in connection with Narkatihaganj Rail P.S. Case No. 10 of 2021.
