Petitioner is apprehending his arrest in connection with Minapur P.S.Case No.330 of 2019 , registered for offences punishable under Sections 272, 273, 419, 420, 120B of the Indian Penal Code and Sections 3(), 41(I) of the Bihar Prohibition and Excise Act..
As per FIR, police intercepted one truck and huge quantity of the liquor (2799 ltrs.) of liquor has been recovered and one person was arrested and he disclosed the name of the petitioner that he has brought the liquor.
Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused there is absolutely nothing against the petitioner either in the FIR or
Patna High Court CR. MISC. No.64974 of 2019(3) dt.20-11-2019 2/2 in the case diary and for that purpose the case diary has been called for. Petitioner has no criminal antecedent also. Heard learned A.P.P. , who could not controvert the above facts. .
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Minapur P.S.case No.330 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
