2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 191 ( 2 ), 190, 126 ( 2 ), 115 ( 2 ), 110 , 303 ( 2 ) and 351 (3) of BNS. 3 . As per F.I.R. informant namely , Abinath Sahni alleged that on 05.07.2024 , all the 8 named accused persons including this petitioner and 10 unknown persons armed with
Patna High Court CR. MISC. No.71489 of 2025(2) dt.13-10-2025 2/3 various weapons, pistol assaulted sister of informant and on the point of pistol, looted cash from her. When informant and his brother went to rescue her sister, they were also assaulted by accused persons.
4. Learned counsel for the petitioner contended that no such occurrence as alleged in the F.I.R. ever took place . As a matter of fact, informant and one of the co-accused persons were on inimical terms and on the date of occurrence , when brother of informant along with brother-in -law of the sister of informant Punit Kumar Sahhni, were going towards Tisidih, they met with an accident and sustained injuries and taking advantage of the situation , this false and concocted case was lodged against this petitioner and other accused persons. F.I.R. does not attribute any specific allegation against this petitioner. Allegation is general and omnibus against this petitioner. 5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, general and omnibus allegation against this petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of
Patna High Court CR. MISC. No.71489 of 2025(2) dt.13-10-2025 3/3 Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Darbhanga in connection with Simri P.S.
