JUSTICE ARUN KUMAR ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner, the learned APP for the State as well as learned counsel appearing on behalf of the informant.

Petitioner, already in custody, seeks bail in connection with Vijayeepur P.S. Case No. 94 of 2017, registered under Sections 302 and 394 of the Indian Penal Code. The First Information Report is instituted against unknown. The informant was stopped on the way in the night, while he was returning to his home, by some miscreants, who tried to snatch his motorcycle and mobile and on being protested by the informant, they assaulted him by means of knife due to which he succumbed to the injuries.

Learned counsel for the petitioner submits that except

No.2766 of 2018 (3) dt.01-02-2018 2/2 the disclosure of the name of the petitioner by one Rajan Gond, there is no other material against the petitioner and he has three criminal antecedents, but in all the three cases he is on bail. In the present case, he is in custody since 10.06.2017. Learned counsel for the State and the informant, referring to paragraphs 48, 52 and 53 of the case diary, submits that besides the confession of said Rajan Gond and others, this petitioner has also made confession, recorded in paragraph 48 of the case diary, and on his disclosure the knife used by him, in stabbing the deceased, was also recovered from the field and the petitioner has also got criminal antecedents of similar nature. Having considered the facts and circumstances of the case, the prayer for bail of the petitioner, above named, is rejected. (Arun Kumar, J) Praveen-II/- U T
