Petitioner, already in custody, seeks bail in connection with Bhaptiyahi PS Case No.139 of 2014, registered under Section 392 of the Indian Penal Code.

Allegation in brief is that the informant was robbed of his motorcycle, some cash and mobile.

Learned counsel for the petitioner submits that the petitioner's name transpired in the confessional statement of a co-accused, however, leading to the confessional statement, no incriminating article has been recovered nor he was put on TIP and the petitioner has been in custody for last two years though he has criminal antecedent several in numbers.

No.4683 of 2018(8) dt.07-05-2018 2/2 Having considered the aforesaid facts and circumstances and the period of custody, petitioner Pampam Singh @ Pampam Yadav @ Singh Jee is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Supaul in connection with Bhaptiyahi PS Case No.139 of 2014 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every day before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled. (Arun Kumar, J) S.KUMAR/- U T
