1. The petitioner claims to be the donor member of Veer Kunwar Singh Mahila College, Nasriganj, Rohtas. He is aggrieved by the formation of the Governing Body and co-option of educationist member in the Governing Body.
2. Learned Counsel for the petitioner submits that the Governing Body and co-option of the educationist
Patna High Court CWJC No.17464 of 2024(2) dt.24-04-2025 2/3 member in the same has been formed in violation of Section 60 of the Bihar State Universities Act and Statute 32 of the Statutes.
3. Learned Counsel for the University submits that as per Clause 2 (ii) of Statute 32 of the Statutes, if the petitioner has any grievance in the formation of or the filling up of the seat in the Governing Body, he may approach the Syndicate of the University and if the petitioner is dissatisfied by the decision of the Syndicate, he shall have the right of appeal before the Chancellor of the Universities within thirty days.
4. I have heard learned Counsel for the parties concerned and have gone through the materials available on record.

Clause 2 (ii) of Statute 32 of the Statutes prescribes that if any difficulty arises in the formation or the filling up of any seat in the Governing Body of any admitted college for any reason what-so-ever, the Syndicate shall on its own initiative or on reference to it shall decide the issue. If anybody, however, is dissatisfied with the decision of the Syndicate, he shall have the right of appeal to the Chancellor within thirty days of the decision whose decision thereon shall be final and binding on the persons

6. Since the Statute provides remedy to the petitioner, accordingly, this writ application is disposed with liberty to the petitioner to approach the Syndicate of the University in terms of the provisions of the Statutes.
7. If the petitioner approaches the Syndicate of the University within fifteen days from today, the Syndicate shall take a decision in this regard within a maximum period of two months.
