JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 The appellant seeks pre arrest bail in connection with Bachwara P.S. Case No. 123 of 2017, registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 3(2) (V) of SC/ST Act.

Allegation as per F.I.R. is that the dead body of the son of informant was found in the maize field and it is suspected that the appellant and others have hand in the murder of the son of informant. It has been submitted on behalf of the appellant that he is not named in the F.I.R. and he has been made accused only on the basis of suspicion as earlier the appellant and others have threatened the deceased and except that there is nothing against the appellant. Heard, learned Special P.P. also.

Having heard both sides, considering the facts and circumstances of the case, let the appellant, above named, in the event of his arrest or surrender before the Court below, be released on

Patna High Court CR. APP (SJ) No.4206 of 2018(4) dt.11-01-2019 2/2 bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge SC/ST Act, Begusarai, in connection with Bachwara P.S. Case No. 123 of 2017, subject to the conditions laid down under Section 438 (2) of Cr.P.C.

Accordingly, this appeal is allowed and impugned order is set aside.
